Upon purchase of any type of membership or service at Premier Athlete Training you agree to the terms listed below.
Member Assumption of Risk and Release
I understand the risk of injury from facility activities and using any facility equipment is significant, including the potential for permanent paralysis
and death, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. I acknowledge that this is an
UNSUPERVISED FITNESS CENTER and I assume all risks associated with using exercise equipment and other products and machines and
exercising alone without the aid and presence of facility staff on the premises. I HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS
PREMIER ATHLETE TRAINING, LLC and its affiliates, as well as all sponsors and advertisers, and all owners and lessors of the premises of
such facility, and their respective officers, affiliates agents, coaches, and employees WITH RESPECT TO ANY AND ALL INJURY DISABILITY,
DEATH, LOSS OR DAMAGE to person or property that may arise out of or in connection with my use of any of the equipment, products,
weights, machines, or the facilities of the facility or any incident that occurs while using such facilities, or otherwise related to my membership.
I expressly agree that this release is intended to be as broad and inclusive as permitted by applicable law and if a portion of this release is held
invalid, the balance shall remain in full force and effect. This release shall apply to my heirs, assigns, personal representatives and any other
next of kin. I understand that the facility is relying on this release in agreeing to enter into this Agreement.
I HAVE READ THE RELEASE OF LIABILITY AND ASSUMPTIONS OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS AND THAT I
HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
I shall indemnify, defend and hold harmless Premier Athlete Training, facility, its affiliates, agents, officers,
and employees from and against any liability, cost or expense, including reasonable attorney’s fees, arising out
of or associated with any claim for damages and/or personal injury, including death there from, to any person or
property damage or loss arising out of the sole negligent conduct or willful misconduct of I or
my partners, officers, employees, affiliates and agents. I hereby confirm that I am aware of and agree to the terms and conditions on this page.
In consideration of participating in Premier
Athlete Training, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from
negligence Premier Athlete Training and its owners, coaches, and volunteers, and any affiliates.and any directors, officers, employees,
agents, volunteers, participants, independent contractors,, on behalf of myself and my children, parents, heirs, assigns, personal
representative and estate, and also agree as follows: I acknowledge that participating in sports camp activities involves known and
unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property.
I further acknowledge that I have been advised of the risks involved in the use of Premier Athlete Training and its equipment, and I further acknowledge that I have been warned that my use of the strength and
conditioning facility and its equipment could result in injury or harm to myself.
I acknowledge and assume any such risk to my person should I use the Premier Athlete Training facility and
its equipment.
In the event that I should sustain injury to myself as a result of my use of the strength and conditioning facility
and its equipment, I hereby agree to hold harmless the Premier Athlete Training , the coaches,
athletic trainers, supervisors, owners, or any other employees.
I have read and fully understand the contents of this “hold harmless” agreement and execute same as my
own voluntary act. By purchasing any type of membership I demonstrate that I agree to the terms and conditions listed.
I acknowledge that all purchases are nonrefundable.
I futher acknowledge that Premier Athlete Training or any third party may take photos or videos of me and/or my son or daughter and utilize them in any public setting or platform they see fit. As a participant of the Premier Athlete Training, there are occurrences where athletes will be photographed or put on video for various functions. These pictures or videos will be used to help promote our program through various forms of media: our website, presentations, or press releases
